The Standard Form (SF) 553, Microbiology I, dated 1 Dec 80, incorrectly filed in his records, be removed. 2. Documentation from his civilian hospitalization be documented in his service medical records. ________________________________________________________________ _ APPLICANT CONTENDS THAT: The SF 553, dated 1 Dec 80 does not belong to him. The person it belongs to has the same first letter of the last name and the same last four of the social security number (SSN). Information from his civilian hospitalization for treatment of injuries from an automobile accident is not included in his military records and may be misfiled in another veteran’s record. In support of his request, the applicant provides a personal statement, and copies of medical documents. The applicant's complete submission, with attachments, is at Exhibit A. ________________________________________________________________ _ STATEMENT OF FACTS: The relevant facts pertaining to this application are contained in the letter prepared by the appropriate office of the Air Force. Accordingly, there is no need to recite these facts in this Record of Proceedings. ________________________________________________________________ _ AIR FORCE EVALUATION: AFMOA/SGAT recommends partial relief. SGAT recommends approval of the applicant’s request to remove the erroneous medical lab slip. SGAT states, the applicant’s request for his civilian medical documentation to be filed in his military records should be made to the Good Samaritan Hospital in Mount Vernon, Illinois. This information would not be readily available in the government medical record unless the applicant authorized a release of information from his civilian facility. The billing information would have been sent to the military facility since they have financial responsibility, but supporting documentation may not have been included. It is difficult to determine from the information provided if the civilian records were misfiled or not available. The complete SGAT evaluation is at Exhibit B. ________________________________________________________________ _ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 18 May 12, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. As of this date, a response has not been received by this office (Exhibit C). ________________________________________________________________ _ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We note the Air Force office of primary responsibility (OPR) has recommended partial relief, by removing the erroneous lab slip (SF 553, Microbiology I) from his master personnel records. The applicant also requests that his civilian treatment records from “Good Samaritan Hospital” be filed in his master personnel records. However, as pointed out by AFMOA/SGAT this request should be made to the applicant’s civilian treatment facility, as this information would not be readily available in the government medical record unless the applicant himself authorizes a release of information from the civilian facility. Therefore, aside from the Board removing the erroneous lab slip, we find no basis for further relief in this case. In view of the above, we recommend his records be corrected to the extent indicated below. ________________________________________________________________ _ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that the Standard Form 553, Microbiology I, dated 1 December 1980, is removed from his records. ________________________________________________________________ _ The following members of the Board considered AFBCMR Docket Number BC-2012-00771 in Executive Session on 18 Oct 12, under the provisions of AFI 36-2603: , Chair , Member , Member All members voted to correct the records, as recommended.
